A Nature Ombudsperson in an Ecological Constitution

Abstract

Since the beginning of modern republics, and with an even greater force since the second half of the 20th century, an institution called Ombudsman has been established in most countries with a Western legal tradition. The main function of this institution is to control the State Administration when it violates people's rights. In the case of Chile, this institution is not yet recognized, so we are far from the global current situation, which could be remedied by the new Constitution. However, in this update, we must also look at the possible creation of an Ombudsperson of Nature, which although in its core has its origin in the Ombudsman, in its functions and practice will fulfill an autonomous and priority purpose: the protection of nature itself, the people related to it, and future generations.
